PAX SCHOOL
Terms And Conditions
Activities Means the various health, safety and wellbeing activities, training, theory and education delivered by Pax Team from time to time, including but not limited to the practical and physical application of law enforcement training and self-defence training, and other associated or similar training involving physical movement and physical exertion including wrestling and running.
I acknowledge, understand and agree that:
1. Pax School is an online platform service delivered by Pax Team that trades and operates in the ‘public’ for the purposes of law enforcement education and training.
2. Pax School educational and training content is delivered by Pax Team. Pax School educational and training content is delivered by Pax Team in 1hr weekly online meetings x 52 nominated weeks.
3. Pax Team Instructors are ex-Police Officers with exceptional lengths of service with exhaustive and rare and policing experience who are accepted individually at law and by the judicial system to be Subject Matter Experts (SME’s) and Expert Witnesses (EW’s) in the field of policing and law enforcement in the public justice and legal system.
4. Pax School (PS) is a forum where Pax Team SME’s will provide education and training. Pax Team recognise the right to free speech, opinions, views, debate and robust discussion with the purpose of education and gaining knowledge and is primarily designed to educate in the public law enforcement jurisdiction, however PS is not restricted to any particular jurisdiction or topic for discussion.
5. Pax Team does not give legal advice.
6. Pax Team doesn’t not make any legal claims.
7. Pax Team acknowledges that the law makes legal claims and the law provides legal advice.
8. Pax Team delivers Subject Matter Expert (SME) advice.
9. On occasion and from time to time, legal advice may be delivered by various experts including Solicitors and Barristers and legal advice will be obvious and clearly labelled ‘legal advice’ by the accredited person according to their practicing certificate and professional licence and qualifications.
10. Pax Team is not a Registered Training Organisation (RTO).
11. Pax Team does not accept Government funding or grants and does not issue certification, accreditation or licensing of any kind in any jurisdiction and is not limited, bound or restricted in any way to delivering content for education and training purposes.
12. I consent to Pax Team conducting identity verification checks, background security checks and any other security checks deemed necessary or desirable, prior to my participation in the Activities, and that these checks will be retained strictly by Pax Team.
13. Pax Team training including Pax School is intended for lawful and legal use and purposes. Pax Team accepts no liability or responsibility for any person who receives any Pax Team education and training through any of the Pax Team training programs including Pax School, who intentionally and or recklessly or carelessly uses the training and education for nefarious, unlawful or unjustified purposes or use, reason or purpose other than for which is intended.
Rules & Directions
14. Pax Team will issue instructions or directions relating to the manner of my participation in the Activities and may, in its absolute discretion, halt and/or exclude my participation in the Activities at any time for any reason Pax Team deems necessary.
15. Pax School financial membership is restricted to an individual only for purchase.
16. Pax School online learning must not be shared or used outside of individual purchase use, except for family use on an individual device.
17. I will comply with all reasonable directions, instructions and decisions (whether written or verbal) of Pax Team given in the course of conducting the Activities
Privacy and Collection of Personal Information
18. I consent to being audio-video recorded during my participation in the Activities (Digital Content) and grant Pax Team permission for the perpetual and ongoing use of any Digital Content generated during the Activities.
19. I agree that my camera is to being activated during the Pax School audi-visual sessions and not be be de-activated, subdued or my identity hidden unless reasonable to do so in the circumstances. Pax Team reserves the right to request and insist a participant to re-activate their camera.
20. Digital Content may be published, exhibited, or reproduced for use on different platforms and mediums, including but not limited to news, promotional material, telecasts, advertising, the Pax Team's website, social media and for any other purpose reasonably required by the Pax Team in the conduct of its business. I consent to the use of any Digital Content in which I may appear unless I notify Pax Team otherwise.
21. By supplying Pax Team with my personal information (including my e-mail address), I consent to Pax Team collecting my personal information for the purpose of conducting the Activities, including identifying participants, recording results, receiving updates on the Activities and general communications about other Activities or services offer by Pax Team in the future.
22. My personal information, data and details will remain absolutely ‘private and confidential’ with Pax Team and not in any way be passed onto any third persons, third parties / entities regardless of jurisdiction without your permission and remain protected pursuant to jurisdictional legislation, legal privileged and warrants for information.
23. I can withdraw my consent to the use of Digital Content by Pax Team or opt-out of receiving email communications at any time by contacting info@paxteam.com.au
Confidentiality
24. I must only use information that is by its nature confidential, or is designated by Pax Team as confidential, including but not limited to, this form and all information, training and direction provided by Pax Team to me in relation to the Activities (Confidential Information), for the purposes of and to the extent necessary to participate in and obtain the benefit of the Activities.
25. Unless expressly permitted by Pax Team, I must keep in the strictest confidence all Confidential Information and must not use, disclose, modify, reverse engineer or make copies, note or records of (or cause or permit the same) any Confidential Information, other than for the purposes of and to the extent necessary to participate in and obtain the benefit of the Activities.
26. At the request of Pax Team, I will return all Confidential Information held by me in physical form, or permanently delete any Confidential Information stored in electronic form and I will provide Pax Team with written confirmation that I no longer hold any Confidential Information.
Withdrawal or Cancellation
27. Prior to the commencement of any Activities:
a) Pax Team reserves the right to refuse my application to participate in the Activities, or having accepted my application, to then cancel my registration in its absolute discretion and for any reason whatsoever. Pax Team is not obliged to disclose its reasons to refusing an application. In such circumstances, I acknowledge that any fees paid by me shall be refunded by Pax Team; and,
b) I may withdraw my application to participate in the Activities at any time, and if I withdraw my application, a 100% refund is applicable. I agree to contact Pax Team on 0488 027 508 or info@paxteam.com.au to notify them of the withdrawal of my application.
28. Once delivery of the Activities has commenced:
a) Pax Team reserves the right to refuse my ongoing participation in the Activities in its absolute discretion at any time and for any reason whatsoever (including but not limited to ensuring my own safety and the safety of others). In such circumstances, I acknowledge that any fees paid by me shall be refunded by Pax Team at their discretion and reasonable in the circumstances which may include a pro-rata rate; and
b) I may withdraw from the Activities at any time, but if I withdraw I am not entitled to receive a refund of any portion of the fee paid to Pax Team for my participation in the Activities, unless Pax Team specifically agrees in writing to such refund. If a refund is agreed, any expenses incurred by the Pax Team in providing the Activities or processing any refund (including administrative costs) will be withheld from the refunded fee. Any refund will at the discretion of Pax Team and will be reasonable in the circumstances which may include a pro-rata rate.
