PAX TEAM
Terms And Conditions
Activities, means the various health, safety and wellbeing activities, training, theory and education delivered by Pax Team from time to time, including but not limited to the practical and physical application of law enforcement training and self-defence training, and other associated or similar training involving physical movement and physical exertion including wrestling and running.
Participant Detail & Health
At the date of commencement of Pax Team training, I am 18 years of age or older.
a) To the best of my knowledge, I am not suffering from a past or present condition or illness (medical or otherwise)that would prevent, impair, hinder and/or render me physically or mentally unable to fully participate in the Activities or that would or may cause injury or harm to myself or any other participant in the Activities.
b) I am physically fit and in good health.
It is my sole responsibility to determine whether I am sufficiently fit and healthy enough to participate in the Activities.
I am solely responsible for my own safety and wellbeing at all times and in all circumstances while participating in the Activities. I agree that I will report to Pax Team any actual or potential injury, concern, impairment or risk that I have or may suffer while participating in the Activities, and that I will restrict my further participation in the Activities should such an issue arise.
Risks & Safety
The Activities may involve a real risk of serious injury or even death from various causes including known and unknown risks, not limited to, over exertion, dehydration, physical trauma, strains, bruises, sprains, muscle tears, broken bones, cuts and other serious personal injury such as, cardiac injuries and heart attacks, permanent disability, paralysis and death, as well as damage to or loss of personal property, all of which may be caused by my own actions or inactions or the actions or inactions of others and the conditions in which the Activities takes place,
I voluntarily assume all risks associated with my participation in the Activities or any actions associated with the Activities, including any risks associated with any health conditions I may have. I will take all measures to protect myself from the risks of participation. I accept all responsibility for medical insurance and for payment and/or reimbursement of medical expenses incurred by me due to participating in the Activities.
I hereby consent to receiving medical treatment that may be deemed by Pax Team as advisable in the event of injury, accident and/or illness during the Activities.
I consent to Pax Team conducting identity verification checks, background security checks and any other security checks deemed necessary or desirable, prior to my participation in the Activities.
I am solely responsible for all property I bring along to the Activities and understand and acknowledge that the Released Party does not accept responsibility for any loss or damage to such property.
I acknowledge that the Activities may be conducted at venues or locations which are not owned or controlled by the Pax Team, and the Pax Team takes no responsibility in relation to the condition or suitability of such venues or locations. I voluntarily assume all risks associated with my participation in the Activities or any actions associated with the Activities at the venues or locations at which they are conducted.
Rules & Directions
Pax Team will issue instructions or directions relating to the manner of my participation in the Activities and may, in its absolute discretion, halt and/or exclude my participation in the Activities at any time for any reason Pax Team deems necessary.
I will comply with all reasonable directions, instructions and decisions (whether written or verbal) of Pax Team given in the course of conducting the Activities, unless such directions, instructions or decisions present a risk to my health or wellbeing.
Privacy and Collection of Personal Information
I consent to being photographed and audio-video recorded during my participation in the Activities (Digital Content) and grant Pax Team permission for the perpetual and ongoing use of any Digital Content generated during the Activities.
Digital Content may be published, exhibited, or reproduced for use on different platforms and mediums, including but not limited to news, promotional material, telecasts, advertising, the Pax Team's website, social media and for any other purpose reasonably required by the Pax Team in the conduct of its business. I consent to the use of any Digital Content in which I may appear.
By supplying Pax Team with my personal information (including my e-mail address), I consent to Pax Team collecting my personal information for the purpose of conducting the Activities, including identifying participants, recording results, receiving updates on the Activities and general communications about other Activities or services offer by Pax Team in the future.
I can withdraw my consent to the use of Digital Content by Pax Team or opt-out of receiving email communications at any time by contacting info@paxteam.com.au
Confidentiality
I must only use information that is by its nature confidential, or is designated by Pax Team as confidential, including but not limited to, this form and all information, training and direction provided by Pax Team to me in relation to the Activities (Confidential Information), for the purposes of and to the extent necessary to participate in and obtain the benefit of the Activities.
Unless expressly permitted by Pax Team, I must keep in the strictest confidence all Confidential Information and must not use, disclose, modify, reverse engineer or make copies, note or records of (or cause or permit the same) any Confidential Information, other than for the purposes of and to the extent necessary to participate in and obtain the benefit of the Activities.
At the request of Pax Team, I will return all Confidential Information held by me in physical form, or permanently delete any Confidential Information stored in electronic form and I will provide Pax Team with written confirmation that I no longer hold any Confidential Information.
Withdrawal or Cancellation
Prior to the commencement of any Activities:
a) Pax Team reserves the right to refuse my application to participate in the Activities, or having accepted my application, to then cancel my registration in its absolute discretion and for any reason whatsoever. Pax Team is not obliged to disclose its reasons to refusing an application. In such circumstances, I acknowledge that any fees paid by me shall be refunded by Pax Team; and
1.2 I may withdraw my application to participate in the Activities at any time, and if I withdraw my application, any refund is subject to Pax Team's cancellation policy provided at the time of the booking on Pax Team's website booking portal or by separate quote, invoice or other written communication from the Pax team, or by other agreement with Pax Team. I agree to contact Pax Team on 0488 027 508 or info@paxteam.com.au to notify them of the withdrawal of my application.
Once delivery of the Activities has commenced
Pax Team reserves the right to refuse my ongoing participation in the Activities in its absolute discretion at any time and for any reason whatsoever (including but not limited to ensuring my own safety and the safety of others). In such circumstances, I acknowledge that any fees paid by me shall be refunded by Pax Team at their discretion and reasonable in the circumstances; and
3. I may withdraw from the Activities at any time, but if I withdraw I am not entitled to receive a refund of any portion of the fee paid to Pax Team for my participation in the Activities, unless Pax Team specifically agrees in writing to such refund. If a refund is agreed, any expenses incurred by the Pax Team in providing the Activities or processing any refund (including administrative costs) will be withheld from the refunded fee. Any refund will at the discretion of Pax Team and will be reasonable in the circumstances.
